Golby Systems LLC, dba Appbite & dba Actually Interacting ("Company," "we," "us," or "our") operates the Actually Interacting dating app and website (the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our Service.

By accessing or using the Service, you agree to the collection and use of information as described in this Privacy Policy. If you do not agree, you may not use the Service. This Privacy Policy should be read alongside our Terms of Service and Cookie Policy.

2.1 Profiling and Automated Decision-Making

We use automated processes, including algorithms, to suggest potential matches based on your profile and preferences. This constitutes profiling under applicable law. This processing is central to the Service and is based on the performance of our contract with you. If you are an EU/EEA resident, see Section 12 for your rights regarding automated processing.

3. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

3.1 With Other Users

Your profile information (such as name, photos, biography, and preferences) is visible to other users of the Service. Messages you send are visible to the recipients.

3.2 Service Providers

We share information with third-party vendors and service providers who perform services on our behalf, including hosting, data analytics, payment processing, customer support, and email delivery. These providers are contractually obligated to use your information only to provide services to us and to maintain appropriate security safeguards.

3.3 Legal Requirements

We may disclose your information if required to do so by law, or in the good-faith belief that such action is necessary to:

• Comply with a legal obligation, subpoena, court order, or government request
• Protect and defend our rights or property
• Prevent or investigate possible wrongdoing in connection with the Service

We retain your personal information for as long as your account is active or as needed to provide you the Service, and afterward for the periods described below:

• Account and profile data: Deleted or anonymized within 30 days of account deletion, unless retention is required by law.
• Messages and chat content: Deleted within 30 days of account deletion.
• Transaction and billing records: Retained for 7 years to comply with financial and tax legal obligations.
• Safety and abuse records: Retained for up to 5 years after account deletion to protect the safety of users and investigate violations.
• Legal holds: We may retain information longer if required by an active legal obligation, court order, or regulatory requirement.

We apply the principle of data minimization and do not retain personal information beyond what is necessary for the purposes described in this policy.

5. Data Security

We implement commercially reasonable administrative, technical, and physical security measures to protect your personal information from unauthorized access, disclosure, alteration, and destruction.

However, no method of transmission over the Internet or method of electronic storage is completely secure. We cannot guarantee absolute security of your information. You are responsible for maintaining the security of your account credentials.

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify the relevant supervisory authority within 72 hours of becoming aware of the breach where required by law, and will notify affected users without undue delay where the breach is likely to result in a high risk.

6. Your Choices and Rights

6.1 Account Information

You may update, correct, or delete your account information at any time by accessing your account settings within the Service. You may also request deletion of your account by contacting us.

6.2 Marketing Communications

You may opt out of receiving promotional emails by following the unsubscribe instructions in those emails. Even after opting out, you will continue to receive service-related communications (such as account notifications and security alerts).

6.3 Push Notifications

You may disable push notifications through your device settings at any time.

6.4 Location Data

You may disable location services through your device settings. Note that disabling location services may limit certain features of the Service.

6.5 Do Not Track

Some browsers offer a "Do Not Track" signal. The Service does not currently respond to Do Not Track signals.

7. New York Privacy Rights

If you are a resident of New York, you may have certain rights under applicable state law, including the right to request information about the categories of personal information we have shared with third parties for their direct marketing purposes. To make such a request, please contact us using the information in Section 13.

8. Children's Privacy

The Service is not intended for anyone under the age of 18. We do not knowingly collect personal information from individuals under 18 years of age. If we become aware that we have collected personal information from a person under 18, we will take steps to delete such information promptly. If you believe we have collected information from a minor, please contact us immediately.

9. Third-Party Links and Services

The Service may contain links to third-party websites, apps, or services that are not operated by us. We are not responsible for the privacy practices of these third parties. We encourage you to review the privacy policies of any third-party services you access.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make changes, we will update the "Last Updated" date at the top of this policy. 12. EU/EEA and UK Residents — GDPR Rights

If you are located in the European Union, European Economic Area, or United Kingdom, you have rights under the General Data Protection Regulation (GDPR) or UK GDPR. This section describes those rights and how to exercise them.

12.1 Data Controller

12.2 EU Representative

As a company based outside the EU/EEA that processes personal data of EU/EEA residents, we are required under Article 27 GDPR to designate a representative within the EU/EEA. Our EU representative is currently to be appointed. In the meantime, EU/EEA residents and supervisory authorities may direct GDPR-related requests and correspondence to us directly at eu-gdpr-requests@actuallyinteracting.com.

12.3 Your Rights Under GDPR

Subject to certain conditions and exceptions, you have the following rights:

Where you object to marketing, we will stop processing immediately. For other legitimate-interest processing, we will stop unless we can demonstrate compelling grounds that override your interests.
• Rights Related to Automated Decision-Making and Profiling (Article 22) — Our matching algorithm constitutes profiling. You have the right to request human review of any significant decision made solely by automated means, to express your point of view, and to contest the decision. You may also opt out of profiling for marketing purposes entirely.

12.4 Withdrawing Consent

Where we rely on your consent as the legal basis for processing (including for special category data and marketing communications), you have the right to withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal. To withdraw consent, use your account settings or contact us at the address in Section 13.

12.5 International Data Transfers

We are based in the United States. When we collect personal information from EU/EEA or UK residents, that data is transferred to and processed in the United States, which may not provide the same level of data protection as your home country.

We rely on the following safeguards for these transfers:

• Standard Contractual Clauses (SCCs) — Where we transfer data to third-party service providers outside the EU/EEA, we use the European Commission's approved Standard Contractual Clauses to ensure an adequate level of protection.
• Any other transfer mechanism recognized as adequate under applicable law.

12.6 Right to Lodge a Complaint

You have the right to lodge a complaint with your local Data Protection Authority (DPA) if you believe we have processed your personal information in violation of applicable law. 12.7 How to Exercise Your GDPR Rights

To exercise any of the rights described in this section, please contact us using the information in Section 13. We will respond to your request within one month. In complex or numerous cases, we may extend this period by a further two months and will inform you of any such extension. We will not charge a fee for reasonable requests but may charge a reasonable fee or decline to act on manifestly unfounded or excessive requests.
