OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Arbitration Agreement (IMPORTANT)

This arbitration agreement and any disputes shall be governed by the Federal Arbitration Act and, where applicable, the laws of the State of New York.

12.6 EU/EEA and UK Users

If you are a resident of the European Union, European Economic Area, or United Kingdom, Sections 12.1 through 12.4 do not apply to you. EU, EEA, and UK consumer protection law prohibits mandatory arbitration clauses and class action waivers from being enforced against consumers. Instead, you may bring claims before the courts of your country of residence, and you retain all rights provided under applicable consumer protection law, including the right to access your national courts and any applicable alternative dispute resolution mechanisms.

13. Governing Law (Non-Arbitration Matters)

To the extent any dispute is not subject to arbitration, these Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles. For EU/EEA/UK residents, nothing in these Terms limits your rights under the mandatory consumer protection laws of your country of residence.

Dating Safety and User Responsibility

1. No Background Checks or Verification

You acknowledge and agree that Golby Systems LLC, dba Appbite & dba Actually Interacting does not conduct criminal background checks, identity verification, or screening of users, except where explicitly stated.
We make no representations or warranties regarding the identity, conduct, intentions, or safety of any user.

Any references to verification features are not guarantees of a user's character or conduct.

2. User Responsibility for Interactions

You are solely responsible for your interactions with other users, both online and offline.
You agree to exercise reasonable judgment, caution, and common sense when communicating with or meeting other users.

Golby Systems LLC, dba Appbite & dba Actually Interacting is not responsible for any harm, injury, loss, or damages arising from interactions between users.

3. In-Person Meetings Disclaimer

Meeting other users in person involves inherent risks, including physical harm, emotional distress, fraud, or other misconduct.

When meeting in person, you agree to:

• Meet in public places
• Inform a trusted third party of your plans
• Arrange your own transportation
• Avoid sharing sensitive personal or financial information

You acknowledge that you assume all risks associated with in-person meetings.

4. Prohibited Conduct

The following behavior is strictly prohibited on the Service:

If you are in danger or experiencing an emergency, you should contact local law enforcement or emergency services immediately.

7. Release of Liability

To the fullest extent permitted by law, you release Golby Systems LLC from any claims, demands, damages, losses, or liabilities arising out of:

• Interactions with other users
• User-generated content
• In-person meetings or communications

This release applies whether such claims are known or unknown at the time.

8. Survival

This Dating Safety section shall survive termination of your account and continue to apply after you stop using the Service.
